1. GENERAL INFORMATION

These Terms and Conditions of Use govern the use of the website www.lisboaromana.pt, hereinafter referred to as "website", property of the Municipality of Lisbon, hereinafter CML.

 Objectives / Services: the main objective of CML websites is to offer its users content, news, services, institutional information, among others.

Access and use of this website is the sole responsibility of the user, who must accept these Terms and Conditions of Use and the Data Protection and Privacy Policy transcribed herein. The use of this website as well as the relations between CML and users are governed by the applicable Portuguese legislation.

CML reserves the right to change these terms and conditions of use, or revise the Data Protection and Privacy Policy, at any time, with or without prior notice. Click "Terms of Use" located on the website to view its current version. The most current version of the Terms and Conditions of Use supersedes all previous versions.

If you do not agree with these Terms and Conditions of Use, do not use the website. These Terms and Conditions of Use and the Privacy Policy constitute an agreement between the user and CML and apply to the use of this website. Users are responsible for reading and reviewing these terms whenever they access the website, in order to become aware of any changes, as these affect their rights.

2. WEBSITE CONTENTS / INTELLECTUAL PROPERTY

 "Website content" includes all information on this website, namely text, images, photographs, videos, illustrations, graphic design and web design. 

All content is protected by Copyright and Related Rights, and Industrial Property rights, under Portuguese and European Union laws, international conventions and other laws, and cannot be used outside the conditions specified on this website and without the consent of CML.

Website contents, or any other industrial or intellectual property rights contained therein, are the property of CML, and their use by unauthorized third parties is expressly prohibited. Website content is provided for personal information and use only. Website content may not be used, copied, reproduced, distributed, transmitted, disseminated, sold, licensed or, in any other way, exploited for any other purpose without the prior written consent of the respective owner. The user may not use, disable or interfere with features related to the security of the Website and the Application.

The user may, however, print material contained in this website, provided that it does not undergo changes, is for personal and non-commercial use, and maintains the indication of the source and copyright, and provided that any other indication of ownership is not removed.

Nothing on this website should be construed as granting any kind of license or other authorization of use to its users.

The website may contain images or other materials whose copyrights belong to third parties, such as suppliers or other entities that contribute to its creation or maintenance (such as stock photos).

The user agrees that use of the website is entirely at their own risk. To the fullest extent permitted by law, CML is exempt from any warranties, explicit or implied, with respect to the use of the website. The CML does not guarantee the correctness or accuracy of the information provided in their websites, and does not assume any liability or responsibility for any (i) errors or imprecise content; (ii) personal injury or property damage, of any nature whatsoever, resulting from access and use of the website and the application; (iii) unauthorized access to or use of our secure servers and/or personal information; (iv) interruption or cessation of transmission to or from our site; (v) bugs, viruses, trojan viruses or the like, which may be transmitted to or through the website; (v) errors or omissions in content, or loss or damage incurred as a result of using the content that is published, uploaded, posted, transmitted, or made available on or through the website; (vi) non-availability or any difficulty or inability to download or access the content, or for any other failure in the communication system, which may have resulted in non-availability of the website.

CML reserves the right to make changes and corrections, change the name, suspend or terminate the website when it deems appropriate and without prior notice to users.

4. EXCLUSION OF LIABILITY

CML does not control or manage the information, products or services of content provided by third parties on the CML websites, as well as links to other websites on the Internet, and therefore is not responsible for errors of any kind, or incorrect data, of these websites and/or content, including their privacy policies and practices. The inclusion of content provided by third parties and links on the CML websites does not imply acceptance of the content on these websites or an association with their owners, nor does it imply CML has any rights to the content of such websites.

Accessing and visiting any of these third-party websites is at the full risk of the user, and the user is responsible for any use and/or consequences resulting therefrom.

CML disclaims any liability for any direct, indirect and/or accidental damages, arising from the use or inability to use the materials contained in this website, and does not control nor is responsible for any illegal, offensive or defamatory conduct of its users.

The website is controlled and offered by CML based on facilities in Portugal. Anyone accessing or using the website from other jurisdictions does so by their own initiative and is responsible for compliance with local laws.

Electronic publications contained in this website are subject to Portuguese law, insofar as it is applicable to them, namely for the purposes of liability for facts, opinions, articles and comments of duly identified persons or bodies, as well as for the protection of sources and other duties, rights and freedoms applicable to the written press.

 5. USER RESPONSABILITIES/ PROHIBITED USES

The user may download or copy material strictly for personal use, but CML remains the owner of the respective copyright.

The user shall not attack or illicitly use CML systems or websites, and will be held responsible and bear all costs associated with illegal actions attributed to same user. Among others, the following are considered illegal actions:

a) Accessing unauthorized area/account and its information; b) Testing and evaluating the vulnerability of the system and break the installed security; c) Installing or attempting to install a virus on the portal; d) Sending unsolicited emails that include promotions or advertising for products or services; e) Triggering or attempting to trigger "denial of service" attacks (attempt to make a system's resources unavailable to its users).

6. SUSPENSION OR INTERRUPTION OF ACCESS

CML reserves the right to interrupt or suspend access to CML websites, for as long as it deems necessary, for any technical, administrative, force majeure or other reasons. Without prejudice to the provisions of the previous paragraph, CML cannot be held liable for any suspension or interruption of access that may occur due to factors not attributable to CML or attributable to mere negligence.

7. ALERT

Without prejudice to the commitment on confidentiality (which should be considered an obligation of means) regarding the use of personal data (to read our Privacy Policy on use of personal data click here), CML warns that there are risks related to the Internet and databases, and personal data contained in the website may be collected and/or transferred by third parties, namely in countries where the systems of protection of personal data are still in underdeveloped and where protection is scarce and ineffective. When accessing CML websites, users must accept the risks inherent to their activity as an internet user, namely the risk of possible open data transfer.

8. SECURITY AND USE OF INFORMATION 

Users of CML websites declare and guarantee  they are fully aware of the characteristics and constraints, limitations and defects of the Internet, and in particular that transmission of data and information via the Internet benefits from variable technical reliability, circulating in heterogeneous networks of diverse technical characteristics and capabilities, which disrupt access or make it impossible in certain periods. Users acknowledge that any website/portal is subject to interference by unauthorized third parties and may consequently be interrupted, and that the information circulating on the Internet is not protected against possible deviations (free access), against possible viruses, and that any person is likely to create a link with access to the website/portal and/or elements contained therein, accepting the inherent risks. In no case can CML be held liable for accidental or voluntary damages suffered by users and caused or not by third parties in the context of using the services provided on its websites or elsewhere on the Internet accessed through these websites. CML is not responsible for any damages that may be caused by the use of the service, including virus contamination.

9. RETENTION OF PERSONAL INFORMATION

Our Data Protection and Privacy Policy is intended to inform users of the general rules for processing personal data, which are collected and processed in strict respect and compliance with the provisions of the personal data protection legislation in force at any time, namely the General Data Protection Regulation (GDPR) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as Law 58/2019, of 8 August, that ensures the execution of said regulation within the Portuguese legal framework.

Retention of this information allows CML to continue to provide personalized services without interruption.

10. TRANSMISSION

These Terms and Conditions of Use and any rights and licenses granted herein may not be transferred or assigned by the user, but may be assigned by CML to third parties without any restriction.

11. INTERPRETATION AND SCOPE

These Terms and Conditions of Use and the Privacy Policy shall be governed by Portuguese law and shall be construed in accordance with Portuguese law.

Conflicts and disputes of any nature relating to the formation, execution or interpretation of this contract, will be governed by Portuguese law and submitted to the jurisdiction of the judicial courts of the region of Lisbon, with express waiver of any others.
